During the COVID-19 pandemic, California implemented a tiered system of restrictions on various activities to prevent virus transmission. Under these restrictions, at-home gatherings, including religious gatherings, were limited to people from no more than three households. However, certain businesses and other secular activities were permitted to operate with larger numbers of people or higher capacity limits. The plaintiffs, who wished to host Bible studies and prayer meetings in their homes with more than three households present, argued that these restrictions violated their First Amendment right to free exercise of religion. They contended that the state was unfairly discriminating against religious activities by imposing stricter limitations than those placed on comparable secular activities that posed similar risks of COVID-19 transmission.
