Swidler & Berlin v. United States

The United States (Respondent) was conducting an investigation about possible false statements or obstruction of justice after several individuals were fired from the White House Travel Office. A Deputy White House Counsel had met with attorneys at the firm Swidler & Berlin (Petitioner) to seek legal advice concerning possible violations of law in connection with the firing of the various White House employees, and the attorneys took handwritten notes at the meeting. Then, the White House employee committed suicide. The Office of Independent Counsel later issued a subpoena for the notes for use in the investigation. Swidler & Berlin filed a motion to quash the subpoena.
