In July 1977, New York City experienced a massive blackout caused by Con Edison’s alleged gross negligence in failing to maintain its power grid. Julius Strauss, a 77-year-old tenant in an apartment building serviced by Con Edison, was injured when he fell on a dark stairway in the common area of his building during the blackout. While Strauss had a direct contractual relationship with Con Edison for electricity in his apartment, the building owner Belle Realty Company had the contract with Con Edison for electricity in common areas. Strauss sued both Belle Realty and Con Edison, claiming that Con Edison’s negligence in causing the blackout led to his injuries.
