The Plaintiff, David Strait, was a minor underage drinking while riding in the Defendant, Terry Crary’s truck. The Defendant, who was driving, was sober throughout the evening. The Plaintiff, who was heavily intoxicated, attempted to climb out of the passenger window and join the other passengers in the back of the truck. While doing so, he fell out and the truck ran over his leg, breaking it.
The Defendant stopped the truck and instead of calling the police, decided to pick up the Plaintiff, place him in the back of the truck, and drive him to the hospital. In doing so, he caused the Defendant additional injuries and pain.
