Stone v. Williams
Citation:
873 F.2d 620 (1989)Facts
Hank Williams, Sr. died intestate on January 1, 1953, leaving behind popular country music songs including “Your Cheatin’ Heart” and “Hey Good Lookin’.” Cathy Stone was born five days later to Bobbie Jett. In 1952, Williams and Jett had executed an agreement acknowledging possible paternity without admitting it, providing for support payments and placing custody with Williams’ mother, Lillian Stone, who adopted the child. After Lillian’s death in 1955, Stone became a ward of Alabama and was adopted by the Deupree family in 1959. In 1967-1968, Alabama courts determined Hank Williams, Jr. was the sole heir. Stone learned of her potential connection to Williams in late 1973 when she turned 21 and received a small inheritance. She read about her possible claim in a biography but took minimal action until 1980 when her adoptive father encouraged her to investigate. Despite increased efforts after 1980, Stone did not file suit until September 1985. During this delay, key witnesses died and defendants entered numerous transactions regarding the copyright interests.
