Mary Martha Stewart was employed as senior vice-president of Colonial Western Agency from October 1997 to January 1998. She alleged she received oral promises of long-term employment and assurances of fair treatment and advancement when the CEO retired. Colonial Western contended Stewart was terminated for cause due to insubordination after she told CEO William Hall he had memory problems and stated she could not work with executive vice-president Richard Mortillaro because he was a liar. During the December 16, 1999 deposition of Douglas Wiskow, a Colonial Western employee and managing agent, defense counsel Marla Wolfe instructed Wiskow not to answer numerous questions about Hall’s treatment of other employees and his behavior, asserting the questions were not calculated to lead to admissible evidence. Plaintiff’s counsel sent a meet-and-confer letter on December 30, 1999, which defense counsel rejected as insufficient on January 3, 2000. Plaintiff’s counsel filed a motion to compel on January 7, 2000, which was granted on January 18, 2000, with $2,400 in sanctions imposed on defense counsel.
