Stern v. Marshall
Citation:
564 U.S. 462 (2011)Facts
Vickie Lynn Marshall (Anna Nicole Smith) married J. Howard Marshall II, an elderly oil magnate, in 1994. After his death, Vickie claimed that J. Howard intended to provide for her through a trust, but his son Pierce had interfered with this gift. During probate proceedings in Texas, Vickie filed for bankruptcy in California. Pierce filed a proof of claim in the bankruptcy proceeding alleging defamation, and Vickie countered with a claim for tortious interference. The bankruptcy court ruled in Vickie’s favor on her counterclaim and awarded her $425 million. Meanwhile, the Texas probate court ruled in Pierce’s favor. The case eventually reached the Supreme Court on the question of whether the bankruptcy court had authority to issue a final judgment on Vickie’s state law counterclaim.
