In this consolidated case, three criminal appeals were all consolidated before the Alaska Supreme Court based upon a shared legal question. In each case, the defendants, including Sharpe (Respondents), sought to introduce expert witness testimony by a polygraph examiner that the defendant was truthful when he made exculpatory statements relating to charges against him during a polygraph examination conducted using the “comparison question technique” (CQT). CQT test results are based on the theory that truthful subjects will have a stronger physical reaction to the broad comparison questions, and deceptive subjects will react more strongly to the specific questions. The State of Alaska (Petitioner) argued that CQT polygraph testing does not satisfy the standard for scientific evidence in order to be admitted as evidence at trial.
