Paredes and Millard’s two-month old son was diagnosed with shaken-baby syndrome. Paredes and Millard were the only two caregivers who watched the child. Paredes eventually confessed to injuring the child, but was convinced by Millard not to confess. Millard later confided in Gail, a social worker, telling her Paredes was non-violent and often was not responsible for taking care of the child. She further told Gail the baby cried frequently when under her supervision, and she had yelled and spanked the child. Gail told further information, in Millard’s presence, which indicated Millard was the individual responsible for the child’s injuries.
At trial, Paredes sought to introduce evidence of Millard’s statements to Gail under the statements against interest exception to the rule against hearsay.
