State v. Loomis
Citation:
881 N.W.2d 749 (2016)Facts
Eric Loomis was charged with five counts related to a drive-by shooting. He denied involvement in the shooting but entered guilty pleas to attempting to flee a traffic officer and operating a motor vehicle without the owner’s consent. The other charges were dismissed but read in for sentencing purposes. The presentence investigation report included a COMPAS risk assessment, which indicated Loomis presented a high risk of recidivism on all measures. At sentencing, the court referenced the COMPAS assessment along with other factors, including the seriousness of the crime and Loomis’s criminal history, in ruling out probation and imposing incarceration. Loomis filed a post-conviction motion arguing that the court’s use of COMPAS violated his due process rights because the proprietary nature of the tool prevented him from challenging its scientific validity, and because it improperly considered gender in its calculations.
