Page and Lambert were walking underneath a highway ramp, when they encountered Gardiner. Lambert contended Page hog-tied the victim, pulled a weapon on him, and beat him. Lambert and Page’s testimony conflicted, but both admitted to beating the man, which ultimately resulted in Gardiner’s death.
During trial, Rodrigues testified Page and Lambert had told her how they had beaten Gardiner. The trial court denied Lambert’s hearsay objection to Rodrigues’s testimony, ruling her testimony was an adoptive admission.
