The defendant was employed as a choir teacher at Hoquiam High School. He had sexual intercourse in his office with a student of the high school choir several days prior to her graduation. At the time, the defendant was 33 and the student was 18.
The defendant was charged with sexual misconduct with a minor in the first degree. He filed a motion to dismiss, arguing that because the statute criminalized sexual intercourse with minors, he committed no crime as the student was 18 years old. The trial court denied the motion to dismiss, but the Court of Appeals reversed the trial court.
