Criminal Law Keyed to Weaver
State v. Guffey
Citation:
262 S.W.2d 152 (Mo. App. 1953).Facts
Conservation agents found a hide from a doe that was hit by an automobile and the agents had it stuffed by a taxidermist using excelsior and boards. The taxidermist used rods for the legs to stand, the doe’s skull so it would hold its shape, and used two small circular pieces of reflective tape for the eyes. The dummy doe was placed in a field and Conservation agents concealed themselves in brush to watch. They observed a car going around 10 to 15 mph with two spotlights sweeping the country side. The agents heard someone from the car say “Wait, there stands one.” The car stopped and a spotlight was held on the dummy and then a shot was fired. The agents stopped the car and the men and recovered one spent shell, a shotgun, a loaded shell, two spotlights, and a flashlight.
