Facts
The State Rubbish Collectors Association (Plaintiff) sued Siliznoff (Defendant) after he took over a trash collection contract formerly held by the plaintiff. Siliznoff was not a member of the association and thus was not legally obligated to pay to take over the contract, but the plaintiff still sought payment. The plaintiff repeatedly requested the defendant for months, and eventually persuaded him to agree to a $500 installment and subsequent $75 monthly payments. Siliznoff filed a cross claim alleging that that he had been coerced by threat of physical force into agreeing to make payments for the contract and that he had suffered emotional distress as a result of this.
