At around 2:00 a.m. on the morning of April 13, 2007, two adult men broke into a truck, damaging the truck and taking its stereo and some CDs. The owner of the truck saw the men and witnessed them walk back to their vehicle. When they opened the door, she also saw M.B. “just sitting” in the passenger seat. A short time later, police stopped the vehicle and arrested its occupants.
The responding officer stated that M.B. and the two men were wearing dark clothing. M.B. was related to the two men. M.B. was found guilty of several charges relating to the vehicular burglary, on the theory of accomplice liability. M.B. appealed.
