Mrs. Elizabeth Stacy died in 1938 at the age of 100. Her daughter, Mrs. Amanda Gresham, had cared for her mother since 1931 when Mrs. Stacy broke her hip and became bedridden. Mrs. Stacy later developed cancer on her nose and suffered from paralysis in her right arm. She was also stone deaf. Mrs. Gresham provided constant care for her mother, performing extraordinary and menial services including lifting her onto a slop-jar, bathing her, changing her bed frequently, and providing all necessary care for an elderly bedridden woman. In 1937, Mrs. Stacy executed a deed conveying her home to Mrs. Gresham, citing her “untiring care” during “many years of illness and helplessness.” In 1938, Mrs. Stacy executed a will leaving her entire estate to Mrs. Gresham for similar reasons. After Mrs. Stacy’s death, both the will and deed were invalidated through legal challenges. Mrs. Gresham then sought compensation for her services through an implied contract claim.
