Thomas Robins filed a class action complaint against Spokeo, Inc., alleging that Spokeo operated as a consumer reporting agency under the FCRA and willfully failed to comply with the Act’s requirements. Robins alleged that Spokeo’s website displayed inaccurate information about him, stating he was married, had children, was in his fifties, was employed in a professional field, was relatively affluent, and held a graduate degree, all of which was incorrect. At the time this misinformation was disseminated, Robins was out of work and actively seeking employment. He claimed this inaccurate information caused actual harm to his employment prospects by making him appear overqualified, expectant of higher salary than employers would pay, and less mobile due to purported family responsibilities. Spokeo’s search engine allows users, including prospective employers, to search for personal information about individuals without disclosing their identities, with much information available for free.
