Thomas Robins discovered that Spokeo, a people search engine company, had generated and published a profile about him containing multiple inaccuracies. The profile falsely stated that Robins was married, had children, was in his fifties, was employed in a professional or technical field, was relatively affluent, and held a graduate degree. At the time this information was disseminated, Robins was actually unemployed and actively seeking employment. Robins filed a class action complaint in federal court alleging that Spokeo, operating as a consumer reporting agency, willfully failed to comply with various FCRA requirements, including the requirement to follow reasonable procedures to assure maximum possible accuracy of consumer reports. Robins alleged that the inaccurate information caused him actual harm to his employment prospects by making him appear overqualified, expectant of higher salary, and less mobile due to purported family responsibilities.
