O.W. and Margaret Lovercheck (Defendants) entered into an agreement with Loren Snyder (Plaintiff) for the sale of their wheat farm. The defendants informed plaintiff that they had previously has problems with the rye in the past, but they believed the problems to be minor. The prior owner of the farm confirmed this information. The parties entered into an agreement for the sale of the farm. The contract explicitly provided that the plaintiff was not relying on any representations made by the defendants. The contract also contained a merger clause and an “as is” clause. After closing, the crops came up, and plaintiff found that the rye problem affect over a third of the farm.
