Snowden v. United States
Citation:
52 A.3d 858 (D.C. 2012)Facts
Lorenzo, Lorenzo Sr., Derrick, DeAngelo, and Scales were standing around in a parking lot celebrating Lorenzo Sr.’s recent release from prison. Lorenzo saw Snowden and recognized him. Snowden entered an apartment building with four boys. He saw Snowden put on a black mask and asked the other boys if they were ready. Lorenzo went to warn his group but as he got there Snowden came around the corner with a gun. Another gunman came around the corner and positioned himself so if the group tried to run the gunman would have the perfect angle to shoot them. Snowden ordered Scales to get up against the fence, Scales gave Snowden $20 that he had in his pocket. Snowden patted him down and Scales grabbed at the gun and tried to wrestle it away from Snowden. Scales yelled to his group to get away and the group fled, the gunman did not shoot them or at them. Scales and Snowden continued to fight and the gun discharged. When the gun discharged Lorenzo looked back and saw Snowden and Scales still fighting. Snowden eventually got free and took off running with his gun and the $20. Scales got up and the other gunman shot Scales in the stomach after raising and lowering his gun a few times. As a result of this, Snowden was charged with multiple crimes, including the charge of aggravated assault with a deadly weapon due to the gunman shooting Scales.
