Slayton v. McDonald
Citation:
690 So. 2d 915 (La. Ct. App. 1997)Facts
The plaintiff and defendant were minor who got into a disagreement on a school bus. At one point, the plaintiff threatened to come over to the defendant’s house. The defendant responded by warning the plaintiff not to come over to his house. The plaintiff was much larger than the defendant and had a reputation of getting into fights. Later that day, the plaintiff arrived at the defendant’s family’s home. At some point, the plaintiff entered the defendant’s home and began talking to the defendant, although the exact circumstances of his entry were disputed. The defendant called 911 to request help. The 911 transcript revealed that the defendant told the plaintiff to leave the house several times, to no avail. What happened next was disputed between the parties, however, the defendant eventually shot the plaintiff once in his left knee.
