CBM Inc. contracted with the State of South Dakota to provide food services at prison facilities in the state. Under this contract, the food provided was to average 2500 to 2700 calories per day. Food substitutions were to be available for inmates who avoided certain foods due to religious beliefs. CBM began serving a new menu at the prisons to accommodate prisoners who followed a kosher diet. Charles Sisney (plaintiff), who followed a kosher diet, alleged that the new menu averaged 400 to 500 fewer calories than the minimum required under CBM’s contract. Douglas Weber, the director of prison services, informed Sisney that he would not address Sisney’s grievances. Weber maintained that Sisney underestimated the actual caloric content of the new menu. Sisney brought suit against the State, Weber, and CBM (defendants).
