The defendants, two owners of a lumber company, were both were arrested at their homes early in the morning of February 25, 1919. While they were detained, representatives of the Department of Justice and the United States marshal went to the office of their company and made a clean sweep of all the books, papers and documents found there without a search warrant. The District Court found that everything was seized in violation of the defendants’ constitutional rights, but the government sought to make copies of the documents and maintain its rights to avail itself of the knowledge which otherwise it would not have had.
