Silas (Plaintiff), a professional basketball player and member of the Missouri National Guard, had his car repaired at the parking lot operated by Bowen (Defendant). The Plaintiff picked up the car in the morning and returned later that evening, complaining that the clutch was still slipping. According to the Defendant, they began to argue and the Plaintiff and his companion approached the Defendant in a threatening manner. The Defendant grabbed a shot gun when the Plaintiff refused to leave the premise, and shot at the ground when the Plaintiff continued to approach him. The Plaintiff was hit in the foot and sued the Defendant for assault and battery. The Defendant argued he was acting in self-defense.
