On October 30, 1997, Shoreline and Eagle entered into a five year licensing agreement. Eagle was in the business of providing taxicab services. Pursuant to the agreement, Eagle could use its radio equipment in a designated space in Shoreline’s tower. There were no restrictions on Eagle’s usage of the space. On May 20, 1999, Eagle assigned the agreement to Norwich, another taxicab company. Norwich did not reserve any additional rights when it took over the agreement. Norwich encountered difficulties installing its radio equipment into Shoreline’s tower, and was ultimately unsuccessful in doing so. In October 1999, Norwich informed Shoreline the agreement was terminated and it stopped making payments.
