Shelksohn v. Yeh

While Johnna Shelksohn was in labor, Dr. Yun Szu Yeh, an anesthesiologist, gave her an epidural. She immediately began to have a seizure, then become comatose, and died seven days later. Her husband Christopher brought a wrongful death action against Yeh, claiming that he had failed to administer a test does to see whether there would be an adverse reaction. At trial, one of the witnesses was Renee Clark, Johnna’s nurse at the time of the epidural. He sought to impeach Shelksohn by presenting the testimony of Nannette Deakin Spector, the nurse who had just gone off duty at the time of epidural, to a statement that Nurse Clark made to her. The trial court did not allow the testimony. The jury found for Dr. Yeh, and Shelksohn appealed.
