Sheehan (Plaintiff) sued Gustafson (Defendant) in Minnesota federal district court under diversity jurisdiction for breaching an oral contract involving the proceeds of the sale of a hotel. Sheehan was a citizen of Nevada, and he alleged in his complaint that Gustafson was a citizen of Minnesota. Gustafson moved to dismiss for lack of subject matter jurisdiction. The court granted the motion, holding that Gustafson was a citizen of Nevada, like Sheehan, and thus there was no diversity of the parties.
