Sedar v. Knowlton Construction Co.

On September 11, 1985, Sedar was injured when he put his hand through a glass door in a building that had been completed by December 31, 1966. Sedar alleged that the glass was not safety glass and constituted a defective and unsafe condition. He filed suit against Knowlton Construction Company, the builder, and Larson & Nassau, the architectural firm. Both defendants moved for summary judgment based on R.C. 2305.131, which bars actions against architects, builders, and others who perform construction-related services more than ten years after completion of such services. The statute was enacted in 1963 as a response to the judicial erosion of the privity doctrine, which had historically limited liability of architects and builders to those with whom they had contractual relationships.
