Contracts Keyed to Dawson
Schultz v. Los Angeles Dons, Inc.
Citation:
238 P.2d 73 (1951)Facts
On July 2, 1948, Schultz signed a contract to play professional football for the Los Angeles Dons for $8,000 for the 1948 season. Prior to signing, he was examined by the team’s physician and found to be in excellent physical condition. Schultz reported to training camp on July 14 and participated in regular training activities and two scrimmages. On July 18, he developed pain in his leg and numbness in his foot, which he immediately reported to the team trainer and coach. He was examined by three orthopedic specialists who diagnosed a herniated disc. On August 12, 1948, Schultz was discharged by the team, which claimed he was not in proper physical condition as required by his contract. Another specialist, Dr. Billig, later diagnosed sciatic neuritis, treated Schultz, and released him to resume football activities on August 23. Despite Schultz’s attempts to be reinstated and his notification on September 25 that he was ready to perform, the team refused to allow him to return.
