In June 1970, Schroeder purchased a used 1970 White truck from Fageol in order to haul automobiles between California and Washington. At the time of purchase, the truck’s odometer read 6,180 miles and Fageol assured Schroeder the truck’s warranties were good for another 94,000 miles. The warranties were contained in the “Owner Book” which Schroeder was given and directed to place in the glove box.
On October 5, 1970, the engine exploded with 50,000 miles still left on the warranty. Schroeder contacted Cummins, whose separate warranty appeared in the Owner Book. Cummins undertook the repairs at no cost to Schroeder. However, after completion of the repairs the truck continued to function improperly and had issues with heating and vibration. Schroeder complained to both Fageol and Cummins and, despite numerous repairs, neither party was successful in fixing the issues.
