Sands v. Menard, Inc.
Citation:
787 N.W.2d 384 (2010)Facts
Dawn Sands began working for Menard, Inc. in June 1999 as Executive General Counsel, overseeing the in-house legal department and serving as company spokesperson. She was paid significantly less than her male predecessor, David Coriden, despite performing equal or greater work. After repeatedly requesting pay increases and being denied, Sands informed management in January 2006 that she believed she had grounds for a lawsuit under the Equal Pay Act. Following this assertion, she was terminated by John Menard on March 14, 2006, in a hostile confrontation. The parties agreed to binding arbitration, where the panel found Menard violated the Equal Pay Act and retaliated against Sands, awarding over $1.6 million in damages and ordering her reinstatement with a salary of $166,250.
