Sampson v. Channell

110 F.2d 754 (1st Cir.), cert. denied, 310 U.S. 650 (1940)Facts
Plaintiff, Mr. Sampson, and his wife were injured in a car accident in Maine. The driver of the other car died following the collision. Mrs. Sampson brought suit in a Massachusetts federal district court against the the executor of the driver’s estate, Defendant, Mr. Channell. The district court found in her favor.
Mr. Sampson also filed suit against Mr. Channell. Channell argued that Sampson was contributorily negligent in causing the accident. Sampson requested that the district court instruct the jury on Massachusetts law as to burden of proof for contributory negligence. The district court declined and instructed the jury on Maine law as to burden of proof for contributory negligence. The jury found in favor of Channell on the issue of contributory negligence. Sampson appealed.
