Constitutional Law Keyed to Choper
Sabri v. United States
Citation:
541 U.S. 600 (2004)Facts
Basim Omar Sabri, a real estate developer in Minneapolis, was charged with three counts of bribery under 18 U.S.C. ยง 666(a)(2) for offering money to a city councilman, Brian Herron, in exchange for assistance with zoning changes and regulatory approvals for his development projects. The City of Minneapolis received over $10 million in federal funds annually. Sabri challenged the constitutionality of the statute, arguing that it exceeded Congress’s authority by not requiring proof of a connection between the bribe and the federal funds. The statute criminalizes bribery of officials of entities that receive at least $10,000 in federal funds in a one-year period, regardless of whether the bribe specifically affects those funds.
