The plaintiff’s ten-year-old daughter was playing outside her apartment building owned by Victory Properties LLC when she was struck in the eye by a piece of concrete thrown by another child. The concrete came from a deteriorating retaining wall on the property. Evidence showed that the landlord had been notified multiple times about the dangerous condition of loose concrete pieces on the property, which children frequently played with. Despite these notifications, the landlord failed to remove the concrete or repair the retaining wall. The injury to the child’s eye was severe, requiring multiple surgeries and resulting in permanent vision impairment.
