When Joseph and Nancy were married, Joseph was employed by Sandia Corporation (Sandia) and he remained employed there through the time of trial. Joseph’s interest in his retirement plan was fully vested and matured. At the time of trial, and he had become eligible to retire but he had not yet decided to retire and did not know when he would do so. Nancy owned a 48% interest in Joseph’s pension benefits. The parties had entered into a comprehensive marital settlement agreement, but that agreement did not specifically provide when Nancy was entitled to begin receiving her interest in the pension plan.
