Monsanto Company is a major chemical manufacturer that develops pesticides through extensive research requiring expenditures of $5 to $15 million annually over 14 to 22 years. Monsanto had incurred costs exceeding $23.6 million developing health, safety, and environmental data submitted to EPA under FIFRA. The company successfully markets only one out of every 10,000 chemicals tested. This proprietary data has significant competitive value beyond the specific registration application, as Monsanto uses it to develop additional products and expand uses of registered products. The data would be extremely valuable to competitors, prompting Monsanto to institute stringent security measures. FIFRA was amended in 1972 and 1978, changing the rules governing EPA’s authority to use submitted data in evaluating other applications and to disclose data publicly. Monsanto challenged these provisions as unconstitutional takings of its trade secret property.
