On February 3, 1996, Kimberly Royster leased a new 1996 Toyota 4-Runner with a three-year/thirty-six-thousand-mile warranty from Toyota Motor Sales. Approximately nine months later, on November 7, 1996, Royster noticed the vehicle leaking red fluid and had it towed to the dealership. The dealership diagnosed a leaking head gasket requiring replacement but experienced difficulty locating the correct part. The repair was not completed until December 31, 1996, leaving the vehicle unavailable to Royster for fifty-five days. Toyota provided a loaner vehicle beginning November 15, 1996. After a subsequent minor repair on January 6, 1997, to address paint and brake issues caused by the extended repair period, Royster experienced no further mechanical difficulties. On May 30, 1997, Royster filed a Lemon Law claim against Toyota.
