Roxas v. Marcos

In 1971, Roger Roxas, a Filipino locksmith and treasure hunter, discovered what he believed to be part of the legendary “Yamashita Treasure” – war booty allegedly buried in the Philippines by Japanese General Yamashita during World War II. After months of excavation in tunnels near Baguio General Hospital, Roxas found a golden buddha statue weighing approximately one metric ton and seventeen small gold bars, which he transported to his home. He also discovered numerous unopened boxes in the tunnels, one of which contained twenty-four gold bars. On April 5, 1971, armed men claiming to be from national security agencies raided Roxas’s home with a purported search warrant, confiscating the buddha, gold bars, diamonds, and other items. Roxas was subsequently arrested multiple times, detained, tortured, and interrogated about the treasure’s location. He was eventually convicted of illegal firearms possession and imprisoned. After Ferdinand Marcos declared martial law in 1972, military excavations occurred at the treasure site, with witnesses observing soldiers removing boxes of gold. Roxas was released in 1974. In 1986, after Marcos was deposed and exiled to Hawaii, Roxas assigned his rights to the Golden Budha Corporation and filed this lawsuit seeking damages for conversion, false imprisonment, battery, and equitable relief.
