The decedent was working for a food catering service on the defendant’s premises. As he was leaving his sleeping quarters, the decedent allegedly fell through a rusted part of a step located just outside of his doorway causing him to sprain his ankle. A few days later, the decedent returned to work and allegedly re-injured his ankle by slipping on some grease on the floor. However, the defendant argued that this second accident was staged.
The decedent consulted multiple doctors about his ankle and reported the injury history to each doctor. The decedent later died of a heart attack. At trial, the plaintiffs tried to admit testimony of the decedent’s statements to his doctors. The district court judge did not allow this testimony on hearsay grounds.
