Plaintiff was driving a vehicle up her driveway, which intersected with the railway owned by Defendant. Her vehicle was stuck on a root which had grown on the railway track. She attempted to move the vehicle, but could not before noticing an oncoming train. She leaped from her vehicle to safety, with the train colliding violently with her automobile. She was not physically touched by the train or debris, although she suffered tremendous fright and shock to her nervous system, which resulted in physical injuries.
