Criminal Procedure Keyed to Ohlin
Rhode Islands v. Innis
Citation:
446 U.S. 291 (1980)Facts
On the night of January 12, 1975, John Mulvaney, a Providence, R.I., driver, disappeared after being dispatched to pick up a customer. His body was discovered four days later buried in a shallow grave in Coventry, R.I. He died from a shotgun blast aimed at the back of his head. Soon after, the police officer spotted the respondent and arrested him and advised him of his Miranda rights. Respondent replied that he understood those rights but that he wanted to speak with a lawyer. The police then directed that the respondent be placed in a caged wagon, a four-door police car with a wire screen mesh between the front and rear seats, and be driven to the police station. While en route to the central station, one officer initiated a conversation with the respondent concerning the missing shotgun. The respondent stated that the officers should turn the car around so he could show them where the gun was located. There, Captain Leyden again advised the respondent of his Miranda rights.
