On August 13, 2012, 76-year-old John Renner stopped at a McDonald’s in Winona, Mississippi while traveling from Jackson to St. Louis. After ordering, he placed his food at a table and walked to the condiment station. When he thought an employee spoke to him, he turned toward the counter before realizing the employee was addressing another customer. As Renner turned back around, his left foot struck a protruding leg of a highchair, causing him to fall and injure his face and left shoulder. Greta Siegel, a frequent patron of the restaurant, witnessed the fall and testified that she had previously seen other customers bump into the highchairs and had complained to management about their hazardous placement. She described how the highchairs were partially hidden behind a “half wall” with legs that protruded further than the tops, creating a tripping hazard. McDonald’s employees allegedly asked immediately after the fall what the highchair was doing there and moved it. Video footage of the incident was reportedly reviewed by a risk management company but was later claimed to be unavailable when requested during discovery.
