The Appellee (F.G. Walker Co.) and the Appellant (Rehm-Zeiher Co.) signed a contract where the Appellant bought whiskey from Appellee for resale. The contract specified an amount for delivery for each year of the contract, but it also contained a term where the Appellee would release the Appellant from the contract for any amount of whiskey each year that the Appellant did not need to buy. For many years, the Appellant did not order the full amount as specified in the contract, and in 1911, the Appellee refused to deliver the remaining amount on the contract although the Appellant requested it. The Appellant then sued on the contract.
