Regina v. Faulkner

13 Cox C.C. 550 (1877)Facts
The defendant, Faulkner, was a sailor aboard a ship carrying a cargo of rum. While at sea, he bored a hole in a cask of rum with the intention of stealing some of the contents. To see what he was doing in the dark cargo hold, he lit a match. The flame from the match accidentally ignited the rum that was flowing from the cask. The resulting fire spread quickly and ultimately destroyed the ship. Faulkner had no intention of setting fire to the ship; his only intention was to steal the rum. He was subsequently charged with and convicted of arson under the Malicious Damage Act, which required proof that he “maliciously” set fire to the ship.
