Redgrave v. Boston Symphony Orchestra, Inc.
Citation:
855 F.2d 888 (1988)Facts
In March 1982, the Boston Symphony Orchestra engaged Vanessa Redgrave to narrate Stravinsky’s “Oedipus Rex” in concerts in Boston and New York. Following the announcement, the BSO received numerous calls from subscribers and community members protesting the engagement due to Redgrave’s political support for the Palestine Liberation Organization and her views regarding Israel. Some callers threatened violence and disruption. On or about April 1, 1982, the BSO cancelled its contract with Redgrave and cancelled the performances of “Oedipus Rex.” BSO agents testified they cancelled not to punish Redgrave for her speech but due to concerns about physical safety and potential disruptions that would compromise the artistic quality of the performance. Redgrave sued for breach of contract and violation of the Massachusetts Civil Rights Act, claiming the cancellation damaged her professional career and interfered with her free speech rights.
