Ragland v. IEC US Holdings, Inc.

Natalie Ragland applied for employment with IEC US Holdings, Inc. (Florida Career College) in 2018, electronically signing an employment application that referenced arbitration. In February 2019, she received and signed an offer letter that stated employment was contingent upon agreeing to the company’s Alternative Dispute Resolution Agreement. When Ragland reported for onboarding, she was presented with the arbitration agreement, which contained an integration clause stating it was the entire agreement regarding dispute resolution and superseded prior agreements. Instead of signing the agreement, Ragland wrote “No Refused” on the signature line. According to Ragland, she had called the business office manager, Barbara Perez, who allegedly told her to “simply put down that I refused” if she was unwilling to accept the arbitration agreement. Perez claimed she did not scrutinize Ragland’s signature and believed it resembled “Na Ragland.” After Ragland later filed age discrimination claims, IEC sought to compel arbitration despite her refusal to sign the agreement.
