There is significant dispute involving the facts, but both parties agreed Dakota went onto the police officer’s property, near the officer’s dog. The police officer contends he feared for the safety of both his dog and wife (standing nearby), which prompted him to fire warning shots, then a shot directly at Dakota. Plaintiff contends her dog went onto the officer’s property and merely sniffed the neighbor dog.
Two days after the incident, Plaintiff learned the dog had died. Upon hearing the news, she collapsed and was given medical treatment.
