Quigley v. Winter

Quigley was the recipient of Section 8 housing vouchers from the Sioux City Housing Authority (SCHA). Winter owned twenty rental homes in the area and rented to many low-income women. In 2000, Quigley, her then-husband, and her four children rented a home from Winter. In 2002, Quigley advised Winter that she was eligible to move into a larger home and Winter drove Quigley to inspect another property. While in the car, Winter rubbed his hand down Quigley’s arm. Afterwards, Quigley, her boyfriend, and her children moved into a different rental property owned by Winter. In 2004, Quigley’s boyfriend moved to Louisiana to care for his ill father. Thereafter, Winter behaved inappropriately toward Quigley on several occasions including entering her house without notice, standing near her and rubbing his genital area, late night inspections of the property without notice, following Quigley and her sister around the house and laying on the couch without invitation, and calling Quigley while intoxicated at inappropriate times of night. Quigley wanted to leave the property, but risked losing her housing voucher if she broke the lease. Winter refused to release her from her lease, and Quigley ultimately changed the locks on the door without giving Winter a key. A month and a half prior to the end of the lease, Winter showed up to Quigley’s house while Quigley, her fourteen year old sister, and Quigley’s friend were lying in the sun. Quigley inquired as to whether her deposit would be returned, and Winter touched Quigley’s stomach and said “My eagle eyes have not seen everything yet.” Winter also touched Quigley’s friend without consent and made inappropriate comments about her minor sister. Quigley moved out and did not receive back her deposit. Quigley also filed a complaint with the Sioux City Human Rights Commission which interviewed other female tenants of Winter’s who corroborated Quigley’s claims.
