Lauren Brenner founded Pure Power Boot Camp in 2003 as a unique military-themed indoor fitness facility featuring an obstacle course modeled after Marine Corps training facilities, with distinctive camouflage decor, crushed rubber flooring simulating dirt, military obstacles, and special design features. She hired former Marines Ruben Belliard and Alexander Fell as fitness instructors, with Belliard eventually becoming head instructor and a trusted confidant. Beginning in August 2007, while still employed at Pure Power, Belliard and Fell secretly planned to open their own competing facility, Warrior Fitness. Belliard stole Pure Power’s confidential business plan, operations manual, startup manual, and client list from Brenner’s private office on multiple occasions. He shared these stolen materials with Fell and with Jennifer Lee, Fell’s girlfriend and silent partner in Warrior Fitness, who used them to draft Warrior Fitness’s business plan. Lee and Nancy Baynard, Belliard’s girlfriend, solicited Pure Power clients while still enrolled there, disparaging Brenner and encouraging clients to join the new facility. Belliard also destroyed employment agreements to conceal contractual obligations. The defendants deliberately left Pure Power understaffed by causing terminations and resignations just before opening Warrior Fitness in May 2008, fifteen blocks from Pure Power’s Manhattan location.
