Pullin v. Superior Court
Citation:
8 Cal. App. 4th 1161, 97 Cal. Rptr. 2d 447 (2000)Facts
Lincoln Pullin slipped and fell on a rainy day in February 1998 at a Vons Market in Inglewood and subsequently sued Vons for negligence in January 1999. Pullin retained Ralph Engdahl, a forensic safety engineer, as his liability expert. When Vons noticed Engdahl’s deposition, Pullin’s attorney requested permission for Engdahl to conduct tests at the store, which Vons refused, citing failure to serve a proper inspection request. On February 17, while the store was open for business, Engdahl visited the store, examined the location of Pullin’s fall, used a small machine to test the floor’s coefficient of friction, purchased an item, and left after approximately fifteen minutes without incident or complaint. Based on his test, Engdahl was prepared to testify that the floor’s coefficient of friction when wet was below acceptable safety standards.
